You are entitled to a percentage of your spouse’s pension plan, which you would have received had you remained married. It is important that you contact an attorney to file a QDRO early on in the divorce process, for your pension rights are eradicated if your former spouse remarries, retires, quits or gets fired, dies, becomes disabled, or withdraws money from the pension before you are able to submit a QDRO.
